Alian Arco Terms & Conditions
Quotes/Estimates
Estimates are only a grade and may not be the final price although care is taken at the time the estimate is given, estimates and quotes are provided as individual and are not one and the same. A Quotation, unless previously withdraw is only valid for 30 days from the date it is given, unless otherwise specifically stated in the quotation. Quotes may vary by a maximum of 10% as is allowed by law.
Pricing
All Prices are payable in New Zealand dollars ($NZD). All charges will be in $NZD and include GST of 15.0%. Delivery Charges if any are based on the delivery destination for local and national orders within New Zealand.
Ordering
Clients are strongly recommended to place any work in writing that they want Alian Arco to carry out by providing a work outline. A deposit of 30% applies up front with the balance due on completion.
Payment
Itemised invoices will be sent out at the end of each month, including during ongoing work where the project runs into the following month, should work have taken in that time. Invoices are payable by the 20th of the following month.
Invoices not paid by the 20th of the 2nd month after invoicing will be charged a late penalty of 2% interest of the total value, not including GST. If unpaid after 3 months a penalty of 5% will be added to this new total. If still unpaid after 4 months a debt collector will be employed to recover the the money owed. The costs of the debt recovery will be added to the unpaid invoice.
Proofs
Authors corrections on and after the first proofs including alterations in style shall be charged as extra. Alian Arco is not a printing company and for that resume we can not 100% guarantee colour matching between RGB and CMYK although the upmost care will be taken. No responsibility will be accepted for errors in proofs passed by costumer.
Liability
Alian Arco shall not be liable for any indirect or consequential loss or for any loss to a costumer arising from third party claims occasioned by errors in carrying out the work or by delays in delivery. Alian Arco is not responsible for any delay, default or loss that the client generates in the process of the work being carry out.
Part Completion
Should the client rescind the contact with Alian Arco before completion of any project, they will be changed and invoice for all work undertaken up to that point.
Title and Risk
Alian Arco retains ownership of title in the Products we design and supply to you until we have received the full Price for the Products and the applicable Delivery Charges.
Copyright
All work produced by Alian Arco is protected under the laws of copyright, and owned by Alian Arco until full payment is received in full. At this time ownership is pass to the client, as does the responsibility to protect their image and brand.
Applicable Law
You are a commercial customer if you acquire goods or services from Alian Arco: (a) that the goods or services not ordinarily acquired for personal , domestic or household use; (b) for use in a business; or (c) for resale or supply to others person in the trade. If you are a commercial customer and you resell goods supplied by us to any customer who is not a “consumer” you agree to: (a) contract out of the Consumer Guarantees Act in respect of the sales of goods; and (b) required your customer to contact out of the Consumer Guarantees Act in respect of any further sales of the goods (other then for resale to a consumer) and to require any sub-sellers to do the same. You indemnify us for any damage or costs suffered as a result of your failure to comply with this clause. You are a consumer if you are not a commercial customer as defined above. If you are consumer, nothing in this document limits or excludes any right you have under the New Zealand Consumer Guarantees Act 1993.
